Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Fancast Cup competitive sports prediction platform ("Service", "we", "us", or "our").

1. Acceptance of Terms

By accessing or using the Fancast Cup Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

You represent that you are over the age of 18. We do not permit those under 18 to use the Service.

2. Description of Service

Fancast Cup is a FREE skill-based sports prediction competition platform that allows users to:

• Make Predictions: Predict outcomes of sporting events across 6+ sports (football, tennis, basketball, etc.)
• Multiple Markets: Predict on match winner (1X2/12), totals (Over/Under), and handicap spreads
• Compete in Tournaments: Daily, weekly, and monthly competitions with free entry
• Earn Points: Accumulate points based on prediction accuracy, with locked point values determined by probability
• Gamification: Earn XP, level up, unlock badges, complete quests, and climb global leaderboards
• Win Virtual Currency: Earn in-game currency for tournament achievements
• Social Features: Chat, comment, like, and interact with the community
• Track Performance: Real-time leaderboards, statistics, win rates, and historical performance

3. User Accounts

Account Creation

To use the Service, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your password
• Notify us immediately of any unauthorized use
• Be responsible for all activities under your account
• Not share your account with others

Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent activity.

Account Deletion

You may delete your account at any time through the app settings. Important information about deletion: See the Delete Account page for instructions and details.

• Immediate Hiding: Your data is immediately hidden upon deletion
• 28-Day Recovery Period: Your data is retained for 28 days in case you change your mind. This prevents accidental loss of rewards, VIP status, and achievements, and protects against fraud by users who delete/restore accounts
• Restoration: During the 28 days, you can restore your account by simply logging in again
• Permanent Deletion: After 28 days, your data is permanently deleted and cannot be recovered

4. Predictions and Tournaments

Making Predictions

• Deadline: Predictions must be made before the scheduled event start time
• Locked Predictions: Once an event begins, predictions are permanently locked and cannot be modified
• Locked Points: When you make a prediction, the point value is "locked" based on current probability and does not change
• Multiple Markets: You can predict on one or all available markets per event (1X2/12, Totals, Handicap)
• Editing: You can edit predictions before the event starts; locked points will update based on your new selection
• Cancelled Events: If an event is cancelled or postponed, all predictions are voided (no points awarded or deducted)
• Responsibility: We are not responsible for missed deadlines, technical issues on your end, or user error

Scoring and Points

• Locked Points System: Each prediction outcome has assigned points based on probability. Higher points = harder prediction
• Correct Predictions: Earn the full locked points for each correct market prediction
• Incorrect Predictions: Earn 0 points (no penalty or point deduction)
• Underdog Bonus: Correct underdog predictions automatically earn higher points due to the locked points system
• Multi-Market Bonus: Predict on multiple markets per event to accumulate more points
• Automated Scoring: Predictions are scored automatically after events are marked "settled" with official results
• Error Correction: We reserve the right to correct scoring errors if data errors occur
• Formula Changes: We may adjust scoring formulas or point values for future events (does not affect locked predictions)
• Disputes: Scoring disputes must be reported within 48 hours of event settlement

Fair Play & Prohibited Conduct

To maintain a fair competitive environment, you agree to:

• No Automation: Do not use bots, scripts, automated tools, or macros to make predictions or interact with the platform
• One Account: Do not create multiple accounts. One account per person, period.
• No Collusion: Do not coordinate with other users to manipulate rankings, share accounts, or gain unfair advantages
• No Exploits: Do not exploit bugs, vulnerabilities, or system errors. Report them to us instead.
• No Manipulation: Do not attempt to manipulate scores, rankings, leaderboards, or point systems
• No Inside Information: Do not use insider information, match-fixing knowledge, or unauthorized data sources
• Authentic Activity: All predictions must be made by you personally, not shared or delegated
• Good Faith: Use the platform in good faith and within the spirit of fair competition

Detection & Enforcement

We use automated systems and manual reviews to detect violations, including:

• Multi-account detection (same device, IP or behavioral patterns)
• Bot detection (impossible prediction speeds, patterns, or activity)
• Collusion detection (coordinated predictions or suspicious user relationships)
• Exploit detection (unusual scoring, data access, or system interactions)

5. Virtual Currency and Rewards

Virtual Currency

• Currency Type: The platform uses in-game virtual currency (coins/credits)
• How to Earn: Virtual currency is earned through tournament participation, quest completion, and achievements
• Monetary Value: Virtual currency does NOT have monetary equivalent and cannot be exchanged for cash
• Usage: May be used for in-platform purposes as determined by us
• No Guarantee: We do not guarantee exchange of virtual currency for any real goods or services
• No Transfer: Virtual currency cannot be transferred between users

Prizes and Rewards

• Free Entry: Participation in all tournaments is FREE. No payment or entry fee is ever required.
• Prize Types: Prizes may include virtual currency, badges, achievements, and recognition
• Discretion: Any physical prizes (if provided) are gifts at the administration's discretion
• No Guarantees: There are no guaranteed physical prizes or payouts
• Right to Cancel: We reserve the right to modify or cancel prizes at any time
• Eligibility: Winners must meet minimum requirements (e.g., minimum number of predictions)
• Forfeiture: Prizes may be forfeited for violations, fraud, or suspicious activity
• Delivery: All physical prizes are shipped exclusively via Nova Post, only within Ukraine, to a post office branch (відділення) or parcel locker (поштомат) chosen by the winner

6. Gamification Features

XP (Experience Points) & Levels

• Earning XP: Earn XP by making predictions (+1 per action), completing quests, unlocking badges, and tournament performance
• Leveling Up: XP increases your level using an exponential formula. Higher levels unlock recognition and perks
• Level Display: Your level is displayed on your profile and may be visible to other users
• No Cash Value: XP and levels cannot be exchanged for cash, prizes, or real-world value

Badges & Achievements

• Earning Badges: Unlock badges by completing specific milestones (e.g., "Make 100 correct predictions")
• Badge Types: Prediction badges, tournament badges, streak badges, sport mastery badges, social badges
• Badge Display: Badges are displayed on your profile and may be visible to other users

Daily & Weekly Quests

• Quest Types: Daily quests reset every 24 hours, weekly quests reset every Monday
• Quest Rewards: Completing quests awards XP, virtual coins, and progress toward badges
• Quest Progress: Track real-time progress in the app
• Automatic Assignment: Quests are automatically assigned; you don't need to manually select them
• No Retroactive Credit: Progress is tracked from the moment quests are assigned; past actions don't count

Referral Program

• Referral Codes: Share your unique referral code with friends
• Rewards: Earn rewards when referred users create accounts and remain active
• Abuse Prevention: Self-referrals, fake accounts, and referral manipulation are prohibited
• Reward Forfeiture: We may revoke referral rewards if fraud is detected

7. User Conduct & Social Features

General Conduct

You agree NOT to:

• Harass, abuse, threaten, bully, or intimidate other users
• Post offensive, hateful, discriminatory, illegal, or inappropriate content
• Spam, advertise, or promote external products/services without permission
• Impersonate others, misrepresent your identity, or create fake accounts
• Share personal information of others without consent
• Interfere with the Service's operation or other users' experience
• Violate any applicable laws, regulations, or third-party rights

Chat & Comments

If you participate in social features (chat, comments), you agree to:

• Be Respectful: Treat others with respect and courtesy
• No Abuse: No harassment, hate speech, or offensive language
• Stay On-Topic: Keep discussions relevant to sports and the platform
• No Spam: Don't flood chat with repetitive or meaningless messages
• Content Moderation: We may remove messages that violate these terms
• Reporting: Use the report function to flag inappropriate content

Consequences

Violations of user conduct rules may result in:

• Warning or temporary mute/suspension from social features
• Permanent account suspension
• Loss of prizes, XP, badges, and rewards
• Reporting to authorities for illegal activity

8. Intellectual Property

Our Content

The Service and its content (including logos, designs, text, and software) are owned by Fancast Cup and protected by copyright and trademark laws.

User Content

By posting content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content in connection with the Service.

You retain ownership of your content but grant us permission to use it for Service operations.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

• We do not guarantee uninterrupted or error-free service
• We do not warrant the accuracy of sports data or scores
• We are not responsible for third-party data providers
• We may modify or discontinue the Service at any time

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for any indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid us (if any) in the past 12 months
• We are not responsible for prize distribution delays
• We are not liable for lost profits, data loss, or business interruption

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your use of the Service
• Your content or conduct
• Your violation of third-party rights

12. Third-Party Services

The Service may integrate with third-party services (e.g., sports data providers). We are not responsible for these third-party services.

Your use of third-party services is subject to their own terms and policies.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting. Material changes will be communicated via:

• Email notification
• In-app notice
• Updated "Last updated" date

Continued use of the Service after changes constitutes acceptance of the updated Terms.

14. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for:

• Violation of these Terms
• Fraudulent activity
• Abusive behavior
• Legal requirements
• Any reason at our sole discretion

Upon termination, your right to use the Service will cease immediately.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ukraine, without regard to its conflict of law provisions.

16. Dispute Resolution

Informal Resolution

If you have a dispute, please contact us first using the contact form at the bottom of this page. We will attempt to resolve disputes informally.

Jurisdiction

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Ukraine.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

19. Entire Agreement

These Terms constitute the entire agreement between you and Fancast Cup regarding the Service and supersede all prior agreements.
